YES! Talent Agency Terms & Conditions

In the following Terms & Conditions Yes! Talent will be referred to as Agency. You and any associated family members applying for representation will be referred to as Talent. By completing the application for representation you accept the following terms and conditions:

 All Talent details provided are correct and will be updated promptly, as necessary.

Unfortunately, not all applicants will be successful through each phase of the process. The Agency will respond within 2 working days of receiving your application. 

If you are successful to move through to the 2nd round, an Agency team member will be in contact with you to confirm a meeting time. The meeting may be virtual (online) or in person. 

The Agency will make a decision within 48 hours of the screening meeting and notify all applicants by email.

The Agency has no annual fee. Talent are however required to cover the costs of: 

  • Supply professional headshots or attend an annual photoshoot with an Agency endorsed professional headshot photographer. 
  • Maintain active accounts on Casting Networks (www.castingnetworks.com.au) and The Extras DB (https://theextrasdb.com)

The Talent ensures that they will maintain active casting profiles on the agency website, Casting Networks, & The Extras DB. And the talent will ensure they will update, as soon as necessary, these casting profiles to ensure details are accurate. 

The Talent gives permission to the Agency to represent them and submit them/their casting profiles for all roles that the Talent fit the criteria for.

The Talent will inform the Agency prior to any change of look to ensure the Agency is not misrepresenting the Talent to clients. Where the change is significant, the Talent understands that an additional photo session (at the Talents expense) may be required to continue being submitted for work.

The Talent will maintain a valid mobile phone (with message services) and an email account to ensure the Agency can contact for work.

The Talent understands that the Agency is at no time considered the employer. Per the ATO ruling the Agency is considered an intermediary between Client and Talent and will invoice the Talent for commission.

The Talent permits the Agency to receive monies on their behalf from the Client into an Agency trust account.
Once the payment is received by the agency from the client, the agency will distribute monies to the Talent via EFT, less PAYG processed by the Client & the Agency commission.

The Talent agrees to the Agency commission structure:

  • 20% (plus 2 % GST) – Extra, TV Commercials, & Photographic
  • 15% (plus 1.5% GST) – Film & TV Series (excluding extras, stand-in, & doubles)
The Talent understands that castings & bookings generally take place within the city.
Castings & bookings often happen on short notice, the Talent has a flexible work schedule to be available for these.
The Talent will inform the Agency of any unavailable period as early as practicable.
Bookings may occur at any time of the day and may require early mornings, late nights and/or long days.
All Talent under 15 will need a parent/guardian accompanying them for the duration of any castings and bookings.

Failure by the Talent to attend confirmed castings or booked jobs may affect your payment and result in withdrawal of representation by the Agency.

The Talent shall not partake in any alcohol or illegal drugs prior to, and while on set, or during any breaks. If you are caught, the production has the right to send you home and this may affect your payment and result in withdrawal of representation by the Agency.
All castings and bookings details are confidential and the Talent agrees to not discuss any aspect with any third party all cameras including mobile devices are strictly prohibited from any sets. If Talent is caught using a camera the production has the right to confiscate it and may send Talent home and this may affect your payment and result in withdrawal of representation by the Agency.
Harassment of any kind will not be tolerated towards Agency staff, fellow talent or clients. The Agency and the production company has the right to send you home and this may affect your payment and result in withdrawal of representation by the Agency.
All child Talents require work permits for booked jobs. These forms will be provided to you prior to a shoot and need to be submitted immediately to Industrial Relations by the Client. These forms usually need to be signed by Parents/Guardians and School Principal (if school age). Timely efforts getting these signed and returned is expected as delay may affect booking the job if the permits are not granted in time.
Representations may be withdrawn at any time by the either party with written 14 days written notice.
Some booked work may have on-going payments in the form of rollover or residuals. The Talent understands that these payments will continue to be paid to the Agency and remitted to the Talent (less PAYG & Agency commission) even after withdrawal of representation.
